These Terms of Service (“Terms”) constitute a legally binding agreement between you and Mileva LLC (“Company,” “we,” “us,” or “our”) concerning your access to and use of the Topsy platform and website.
1. General Wellness Disclosure (Non-Medical)
Topsy is not a medical provider. The Topsy Longevity Index, Educational Insights, and any other data provided through the platform are for informational and general wellness purposes only. We do not provide medical advice, diagnosis, or treatment. Our platform is designed to track physiological trends and resilience markers, not to replace professional medical consultation. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition.
2. Eligibility & Account
By using Topsy, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Integration with Third-Party Services (Garmin Connect™)
Topsy functions by integrating with your Garmin Connect™ account to establish a high-fidelity biological baseline. Your use of Garmin services is governed by Garmin’s own terms and privacy policies. Mileva LLC is an independent entity and is not affiliated with, endorsed by, or sponsored by Garmin Ltd. or its subsidiaries. We are not responsible for the accuracy or availability of data provided by Garmin sensors or the Garmin Connect™ API.
4. Data Sovereignty & Ownership
As outlined in our Privacy Policy, you maintain ownership of your raw biological data. You grant Mileva LLC a worldwide, non-exclusive, royalty-free license to process your data solely for the purpose of generating your Longevity Index and associated insights. We operate under a zero-monetization model; we do not sell your personal biological records to third parties.
5. Limitation of Liability
To the maximum extent permitted by law, Mileva LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform. Your use of the Topsy Longevity Index is at your own risk.
6. Termination
We reserve the right to suspend or terminate your access to Topsy at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties (including Garmin).
7. Governing Law
These Terms are governed by and construed in accordance with the laws of Wyoming, without regard to its conflict of law principles.
